Article 1 – Definitions
« Data » means all data from solar lighting equipment.
« Application » means the mobile application called « NOVEA LINK » to help with the supervision, diagnosis and assistance of solar lighting equipment developed by Novéa Energies, viaa mobile application available on the Android or iOS download platform, and as described in Article 2 below.
« User » means the natural person who benefits from the services provided.
« Administrator User » means a User with administrator access to the Application, allowing them to create, manage and delete access accounts for other Users.
Article 2 – Purpose
The NOVEA LINK application allows you to:
- Retrieve operating information from the paired and assigned pole
- Quickly diagnose a fault and request assistance in one click
- Push an update transmitted by Novéa Energies to the paired light point
- Manage your fleet through projects and sub-projects and access for your team
- Test the modulation of your lights in live

The NOVEA LINK Application is produced by Novéa Energies, a subsidiary of the RAGNI GROUP.

Article 4 – Use of the Application
Access to the Application is via sending a secure email to the email address indicated by the User or by password.
The User must act as a professional and undertakes to use the Application only for the needs of his professional activity. The User undertakes to use the Application in accordance with the GTU, in compliance with international, European and national laws and regulations applicable in France.
It is strictly forbidden to use the Application for purposes other than those for which it was designed, or to infringe the rights or security of third parties, public order or the violation of laws and regulations in force.
In the event of non-compliance with this article, Novéa Energies may suspend all access and, where applicable, terminate the User's and/or Administrator User's access to the Application, without prejudice to any damages that Novéa Energies may claim.
Novéa Energies will provide, during the period of use of the Application, electronic assistance relating to the use and operation of the Application. Novéa Energies reserves the right to subcontract this assistance to another subsidiary of the RAGNI GROUP specializing in connected solutions: SEVe.
To function properly, the Application requires access to various features, always with your explicit authorization:
- Geolocation: to locate surrounding lighting points
- Bluetooth®: to communicate with solar lighting equipment
- Camera and/or storage: to attach images to the assistance request
To access the Application, the User must have an Android or iOS smartphone, a high-speed internet connection and access to their email inbox on the same terminal.
Article 5 – Data Management
NOVEA ENERGIES is attentive to the protection of Users’ Personal Data and undertakes to protect them at all times, in accordance with the Regulations applicable to the protection of Personal Data.
The User acknowledges and accepts that the Personal Data concerning him/her, collected by Novéa Energies as part of the execution of the GTU, are necessary for access to the Application and its use. This Personal Data may also be processed for statistical purposes to improve the performance and functionality of the Application. Unless required by law or court to do so, Novéa Energies undertakes not to transmit the User's Personal Data to third parties other than the Application's developer host or the subsidiary of the RAGNI GROUP specializing in connected solutions (SEVe), acting as subcontractors of Novéa Energies within the scope of the Regulations applicable to the protection of Personal Data, in accordance with the contract that binds them and which may not deviate from this article.
The User expressly authorizes the use of subcontracting for the proper functioning of the NOVEA LINK Application, this authorization also covering the performance of all or part of the Personal Data processing activities. Novéa Energies ensures that any subcontractor it recruits meets the requirements of the Regulations applicable to the protection of Personal Data and guarantees the protection of the rights of the data subjects. Novéa Energies remains responsible to the User for the performance of its obligations by its subcontractors.
The User's Personal Data will be retained as long as their access is active. They will then be archived, in a secure environment compliant with the requirements of the Regulations applicable to the protection of Personal Data, for the legally required period necessary for evidence purposes for the establishment, exercise, or defense of a legal claim. The User has the right to access, rectify, limit, and port their Personal Data. The User may exercise their rights at any time by contacting Novéa Energies by email at the following address: contact@novea-energies.com. Proof of identity will be required to verify their identity.
The User may also file a complaint with the French Data Protection Authority (CNIL) if they believe that the processing carried out by Novéa Energies constitutes a violation of their Personal Data.
The User who integrates or processes third-party Personal Data as part of the use of the Application undertakes to comply with the provisions provided in article 9.2 below. The User guarantees Novéa Energies against any claim in this respect. The Administrator User who creates access for other Users is solely responsible for the accuracy of the User’s data and the proper management of the access they provide.
Article 6 – Properties
The Application and its textual and graphic contents as well as all distinctive signs (names, brands, logos), are protected by existing or future intellectual property rights, French and international, and belong to Novéa Energies or to third parties having authorized Novéa Energies to exploit them. The use of the Application does not in any way confer on the User a right of ownership and/or an intellectual property right over the Application and its contents, with the exception of a personal right of access, non-exclusive and limited exclusively to the use of the Application in accordance with its object and purposes and in compliance with the GTU. It is strictly forbidden to represent, reproduce, distribute or exploit the Application and its contents in whole or in part, in any form and by any means whatsoever. Failure to comply with the provisions of this article constitutes a violation of the intellectual property rights of Novéa Energies and third-party grantors and may result in civil and criminal proceedings.
The Data is the exclusive property of the User. Novéa Energies may not claim any rights of any kind over this Data, with the exception of a right to use it for statistical, operational and assistance purposes, to the exclusion of any other purpose, particularly commercial, and in strict compliance with the confidentiality of this Data.
Article 7 – Responsibilities
Access to and use of the Application by the User is the sole responsibility of the latter and may not in any way engage the liability of Novéa Energies, in any capacity whatsoever.
The User expressly acknowledges having received from Novéa Energies all the necessary information, allowing him to assess the suitability of the Application to his needs and to take all useful precautions for its implementation. No advice or information, whether oral or written, obtained by the User when using the Application is likely to create guarantees not expressly provided for by the GTU or to result in the liability of Novéa Energies in the event of damage, of whatever nature, caused to the User or to third parties due to the misuse by the User of the Application, in violation of the provisions of this article and more generally of non- compliance with the GTU.
Novéa Energies is subject to an obligation of means in the provision of the Application but does not provide any other guarantee as to the continuity, performance and/or durability of the Application nor does it guarantee that it is free from anomalies or that it will operate without failure or interruption. The Application is distributed “as is” and according to its availability.
Novéa Energies may, at its sole discretion, provide updates to the Application to maintain compliance with the legislation and regulations in force, to adapt the Application to technological developments in networks and computer equipment and/or to improve the use of the Application.
Article 8 – Acceptance of the GTU
Access to and use of the Application are subject to the User’s acceptance of the GTU.
By clicking on "Accept all" in the GTU window at the first connection, the User acknowledges having read the GTU, having understood them and fully accepted all of their provisions, without restriction or reservation.
Novéa Energies reserves the right to modify and/or update the GTU at any time without notice, of which the User will be notified. Access to and use of the Application will be subject to the T&Cs in force at the time of such access and use.
In the event that one of the clauses of the GTU is void due to a change in legislation or regulations or declared as such by a final court decision, this shall in no way affect the validity and compliance with the other clauses of the GTU.
The GTU come into force upon their acceptance by the User and for the entire duration of access to and use of the Application by the User.
The GTU will be executed and interpreted in accordance with French law.
